Note: “Lender” is the artist or owner loaning objects to The Manny Cantor Center for exhibit. “Object” refers to artwork, artifact or any other object loaned for purpose of display; singular may also indicate plural. The lender listed below agrees to lend the object/s to the Manny Cantor Center, subject to the attached conditions, as well as deliverables below.

PUBLIC EXHIBITION: Lender agrees and understands Manny Cantor Center’s desire to obtain the use of the Lender’s object for a public display. Lender certifies that he/she is the creator and/or owner of the object/s and has full legal rights to lend the object, enter into this loan agreement and to sell the object, if so indicated.

INSTALLATION: All objects must be suitably presented to hang or install. Objects which need assembly must have easy-to-follow instructions, or the Lender must be present to assist with assembly. Lender must prepare the object for public display with appropriate framing, support, and protective materials. Should the Lender choose the use of frameless frames for the presentation of artwork, the Manny Cantor Center is not responsible for damage to artwork or for broken glass.

Manny Cantor Center retains full responsibility and discretion for the installation of the object at Manny Cantor Center.

RIGHT OF REJECTION: Manny Cantor Center reserves the right to reject any object for the exhibit.

CARE AND PRESERVATION: Manny Cantor Center will use the highest degree of care in its handling, installation, protection and maintenance of the object. Evidence of damage at the time of receipt or while in Manny Cantor Center custody will be reported immediately to the Lender. No alteration or repairs will be undertaken without the authorization of the Lender. The Lender certifies that the objects lent are in such condition as to withstand ordinary strains of handling, transportation and installation. Manny Cantor Center is not responsible for repair or loss due to defective workmanship or materials.

WITHDRAWAL: No exhibited work will be withdrawn by the Lender while on loan.

DELIVERY OF LOANED ARTWORK: The Lender is responsible for the delivery of objects to Manny Cantor Center on the delivery dates or the cost of shipping the objects to Manny Cantor Center.

INSURANCE: Objects will be insured under a policy obtained by Manny Cantor Center for loss or damage during the period of the loan, subject to standard exclusions. Insurance value is 60% of the value of the object which is indicated by the Lender on their entry form or inventory form. If the Lender fails to indicate an amount, Manny Cantor Center will set a value for purposes of insurance for the period of the loan. The amount payable by the insurance is the sole recovery available to the Lender in the event of loss or damage. In the event of loss or damage, the insurance company reserves the right to assess value.

RETURN OF LOANED ARTWORK: Unless otherwise notified in writing the object will be released only to the Lender. The Lender is responsible for the return delivery of objects or the cost of return shipping of the objects.

REPRODUCTION: Unless otherwise noted in writing, the object/s may be photographically reproduced by Manny Cantor Center for educational, promotional and publicity purposes. Manny Cantor Center may use the Lender’s name and image for publicity purposes.

MODIFICATION: This agreement constitutes all the terms between Manny Cantor Center and the Lender when signed by all parties. Manny Cantor Center will try to accommodate any additional requests, which must be written in the space below. This Loan Agreement is the entire agreement between Manny Cantor Center, and the Lender.
